SHIPPING AND ORDER DELIVERY

Once you have completed the purchase process at Danna Pet Food, your order will be registered in our system and will be processed for shipment once the payment has been made and verified.

Shipments of goods will usually be made via courier to the destination you have chosen within the Iberian Peninsula (Spain and Portugal).

You will receive your order within a delivery period of 5 to 7 business days, depending on the destination location and the payment method you have selected, once we have confirmed both the availability of the goods and that the payment has been successfully processed.

Non-Performance of the Distance Contract

In the event that the product is not available within the expected timeframe, we will inform you so that you can proceed with the cancellation of the order and receive a full refund, at no cost to you and without any liability for damages attributable to Danna Pet Food.

Danna Pet Food shall not assume any liability if the delivery of the product or service is not completed due to false, inaccurate, or incomplete information provided by the CUSTOMER.

Delivery will be considered complete at the moment the carrier makes the products available to the CUSTOMER and the CUSTOMER, or their delegate, signs the delivery receipt.

It is the CUSTOMER’s responsibility to verify the condition of the products upon receipt and to note any justified exceptions or claims on the delivery receipt document.

RIGHT OF WITHDRAWAL

If you wish to exercise your right of withdrawal, you must send us a notification at info@dannapet.com. Please note that you have a period of fourteen calendar days from the date of receipt of the product to exercise this right.

If Danna Pet Food fails to comply with the obligation to provide information and documentation regarding the right of withdrawal, the period to exercise this right will expire twelve months after the end of the initial withdrawal period (Article 71 of Law 3/2014, of March 27).

The right of withdrawal shall not apply in the following cases:

1. When the product packaging is not original or is not in perfect condition, Dannapet may charge the cost of the packaging. The original packaging must protect the product so that it is received in perfect condition. The use of seals or adhesive tapes applied directly to the packaging is prohibited to avoid the costs of replacement.

2. When the product has been opened without the possibility of demonstrating that it has not been used.

3. The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons, and that have been unsealed after delivery.

4. The supply of products which, after delivery and considering their nature, have been inseparably mixed with other goods.

All returns must be communicated to Danna Pet Food by requesting a return number via email at info@dannapet.com, indicating the corresponding invoice or order number.

If the return is not made using the original delivery packaging, Danna Pet Food may charge the CLIENT for the cost of the replacement, after informing them in advance through the same communication channel used.

Any incident will be attributable to the party responsible for it. Danna Pet Food will cover the costs of those incidents that are directly its responsibility.

FORCE MAJEURE

The parties shall not be held liable for any failure resulting from a force majeure event. The fulfillment of the obligation will be delayed until the force majeure situation has ended.

JURISDICTION

The CLIENT may not assign, transfer, or convey the rights, responsibilities, and obligations contracted in the sale.

If any provision of these terms is deemed null or unenforceable, the validity, legality, and enforceability of the remaining provisions shall in no way be affected or altered.

The CLIENT declares that they have read, understood, and fully accepted these Terms and Conditions.

PRICE AND VALIDITY PERIOD OF THE OFFER

Product prices include Value Added Tax (VAT) or any other applicable taxes. Unless expressly stated otherwise, these prices do not include shipping costs or any additional or related services to the purchased product.

The applicable prices for each product are those published on the website and will be stated in EURO currency. The CLIENT acknowledges that the pricing of some products may vary in real time.

Before making the purchase, you will be able to review all the details of the quote online: items, quantities, price, availability, discounts, taxes, and the total amount. Prices may change daily until the order is placed.

All payments made to Danna Pet Food entail the issuance of an invoice in the name of the registered CLIENT or the business name provided at the time of placing the order. Once the shipment is confirmed, the CLIENT will receive a delivery note with the order details. If the CLIENT wishes to receive the invoice by email, they must request it through any of the contact channels provided by Danna Pet Food.

    PURCHASE PROCESS

    Any product from our catalog can be added to the cart. The cart will display the items, quantity, price, and total amount. Once the cart is saved, taxes, charges, and discounts will be calculated based on the payment and shipping information provided.

    Carts have no administrative validity; they are merely a section where a quote can be simulated without any commitment from either party.

    From the cart, an order can be placed by following these steps to complete it properly:

    1. – Verification of billing information.

    2. – Verification of the shipping address.

    3. – Selection of the payment method

    4. – Place the order (purchase).

    Once the order has been processed, the system instantly sends an email to Danna Pet Food’s management department and another to the CLIENT’s email address confirming the order placement.

    Orders (Purchase Requests)

    Within a maximum of 24–48 business hours, an email will be sent to the CLIENT confirming the order status and the estimated shipping and/or delivery date.

    SEVERABILITY AND SUSPENSION OR TERMINATION OF THE CONTRACT

    If any of these terms and conditions are deemed illegal, void, or for any reason unenforceable, that provision shall be considered severable and shall not affect the validity and enforceability of the remaining provisions.

    Danna Pet Food may, without prior notice, suspend or terminate the CLIENT’s access to its services, in whole or in part, for any valid reason, including but not limited to the CLIENT’s failure to comply with any of the obligations set forth in this document or any applicable law, license, regulation, directive, code of practice, or acceptable use policy.

    PROMOTIONS

    The company reserves the right to cancel the order if the maximum purchase limits established for any active promotion are exceeded, in order to ensure product availability.

    13. WARRANTIES AND RETURNS

    General Principles

    The seller is obligated to deliver to the consumer and CLIENT products that are in conformity with the contract and is liable for any lack of conformity that exists at the time the product is delivered.

    Scope of Application

    This section applies to sales contracts for products that are to be produced or manufactured.

    Seller’s Liability and Consumer and CLIENT Rights

    If the reason for the return is not attributable to Danna Pet Food, the transportation cost will be borne by the consumer. The consumer may choose to handle the return independently or through Danna Pet Food, S.L.’s customer service, with the corresponding cost to be agreed upon at the time of the incident. This cost will be deducted from the total amount to be refunded once the product arrives at the facilities of Nugape Pet Food, S.L.

    APPLICABLE LAW AND JURISDICTION

    These terms and conditions shall be governed by and interpreted in accordance with Spanish law, except where expressly stated otherwise. Danna Pet Food and the CLIENT agree to submit any dispute that may arise from the provision of the products or services covered by these Terms to the courts and tribunals of the domicile of Danna Pet Food.

    In the event that the CLIENT resides outside of Spain, both Danna Pet Food and the CLIENT expressly waive any other jurisdiction and agree to submit to the Dispute Resolution Body that will act as an intermediary between the parties, in accordance with Article 14.1 of Regulation (EU) 524/2013, without the need to resort to the courts of law.
